DT 1357 Foreign national (serving) prisoners: a course for immigration and prison law practitioners

The Prison Service has in late November 2011 introduced important new policy guidance which will affect Home Detention Curfew, Categorisation and Parole for foreign national serving prisoners. As well as providing an introduction to those unfamiliar with the topic, this course will provide an essential update for those already working with foreign national serving prisoners.

Foreign National Prisoners: law and practice by Laura Dubinsky with Hamish Arnott and Alasdair Mackenzie is published by Legal Action Group on 8 February. ILPA and the Association of Prison Lawyers join forces to present a  course about foreign national prisoners who are still serving their custodial sentences by the authors of Legal Action Group’s Foreign National Prisoners  on the day the book is launched.  
The course will address specific hurdles affecting foreign nationals in the prison system, applicable release and removal mechanisms, and available remedies covering categorisation and allocation of prisoners, early removal and repatriation.  Suitable for immigration practitioners with no detailed knowledge of prison law, a chance to learn how to do your best for these clients.   

Hamish Arnott is a partner at Bhatt Murphy solicitors in London specialising in public law and human rights with a particular focus on the civil liberties of prisoners and those detained under immigration laws. He is the co-author of the leading prison law text, Prisoners: law and practice (LAG, 2009). 

Laura Dubinsky is a barrister at Doughty Street Chambers. She practices in public law,

specialising in immigration law, prison law and challenges to administrative detention; and is

also frequently instructed in civil actions against detaining authorities.

Aim of course:On 31 December 2010 there were a total of 7,683 FNPs serving a custodial sentence: over 9% of the total prison population. Foreign national prisoners have distinct legal needs which straddle immigration and prison law and often remain unmet. Their immigration status will usually affect each stage of their progression through the prison system, whether or not they will ultimately be removed or deported. This course aims to familiarise practitioners with the specific hurdles affecting foregin nationals in the prison system, applicable release and removal mechanisms, and available remedies.
