The Immigration Act 2016: its implementation and challenges in Wales, paper for the Public Law Project Conference Cardiff, 20 June 2016

This paper begins with a note on how provisions of the Immigration Act 2016 are commenced, considers the implications of devolution for the implementation of the Act in Wales, then provides an overview of its main provisions following the structure of the Act:

  • Labour market enforcement and illegal working;
  • Access to services (restrictions on renting, driving and bank accounts);
  • Enforcement (including immigration detention and bail);
  • Appeals;
  • Support for certain categories of migrants;
  • Language requirements for public sector workers; and
  • The Immigration Skills Charge.
